Passenger Injured When Car Leaves Road Awarded Over 340,000 Yuan Compensation

A passenger in Zhejiang Province has been awarded over 340,000 yuan in compensation after suffering serious injuries when the car she was riding in left the road and crashed. The driver was found fully responsible for the single-vehicle accident.

The accident occurred on December 12, 2009, at around 7:10 PM on a rural road in Linhai City. The driver was operating his own car when he lost control at a curve, causing the vehicle to leave the road and fall down an embankment. The passenger suffered multiple injuries to her chest and legs.

Traffic police investigated and determined that the driver bore full responsibility for the accident. The driver had failed to take appropriate measures when facing danger, causing the vehicle to leave the roadway. The passenger had no responsibility.

The passenger was taken to a hospital for treatment. A forensic assessment later determined that her injuries constituted a seventh-level disability and a ninth-level disability under traffic accident injury standards. These are significant disability ratings that affect long-term earning capacity.

The passenger filed a lawsuit seeking compensation for medical expenses of 104,069 yuan, nursing fees of 8,460 yuan, hospital meal allowances of 4,230 yuan, lost wages of 29,473.47 yuan, disability compensation of 229,815.6 yuan, transportation costs of 2,700 yuan, assessment fees of 1,200 yuan, nutritional supplements of 3,000 yuan, future treatment costs of 6,000 yuan, and emotional distress compensation of 10,000 yuan.

The driver acknowledged responsibility for the accident and expressed willingness to compensate the passenger for reasonable losses. He had already paid 25,000 yuan toward medical expenses, including 19,000 yuan directly and 6,000 yuan from a traffic accident deposit fund.

The vehicle had commercial insurance with coverage for passenger injuries up to 10,000 yuan. The insurance company agreed to have this coverage addressed in the same proceeding.

The court calculated the passenger’s total losses and ordered the driver to pay compensation after deducting amounts already paid. The insurance company was ordered to pay 10,000 yuan within the passenger injury coverage limits.

This case illustrates how passengers injured in single-vehicle accidents can recover full compensation from the driver when the driver’s negligence caused the crash. Passengers are generally presumed to have no responsibility unless they contributed to the accident through their own misconduct.
