In October 2011, a motorcyclist collided with a cyclist traveling in the same direction on a rural road in southern China. The cyclist, a 70-year-old man, was thrown from his bicycle and suffered a right femoral fracture and rib injuries. He was hospitalized for 92 days and subsequently assessed as having a Level 10 disability under Chinese traffic injury standards.

A traffic police investigation determined that the motorcyclist bore full responsibility for the accident. The rider was operating with an expired license and had failed to maintain required safety inspections on the motorcycle.

The injured cyclist sought compensation for medical expenses, hospital meal subsidies, nursing care, disability benefits, and assessment fees. The total claim was 38,201 yuan.

The court examined the traffic police determination, hospital records, and the medical assessment report. The court upheld the police finding that the motorcyclist was solely at fault. The motorcycle owner, who had allowed the rider to operate the vehicle, was held jointly liable for the damages.

The court recalculated the compensation based on applicable standards. Medical expenses were confirmed at 12,631 yuan, though the plaintiff claimed only 10,131 yuan excluding the 2,500 yuan already paid by the defendant. Hospital meal subsidies were set at 2,730 yuan based on the plaintiff’s request for 91 days at the standard daily rate.

However, the court made several adjustments to the plaintiff’s claims. The disability compensation was calculated over 10 years rather than the 20 years requested, as the plaintiff was already 70 years old. Nursing care fees were recalculated using the rural resident income standard rather than the higher rate claimed. Claims for transportation and nutritional expenses were dismissed due to insufficient documentation.

The final award totaled 27,643 yuan, covering medical expenses, hospital subsidies, nursing care, disability compensation, and assessment fees. Both the motorcycle rider and the vehicle owner were held jointly liable.

This case illustrates the importance of maintaining valid licenses and safety inspections. Vehicle owners who permit others to operate their vehicles may face liability for resulting accidents. Injury claims should be supported by proper documentation to ensure full recovery.
