A court in eastern China has ordered a driver to pay 46,901.48 yuan in medical expenses after his electric tricycle collided with a pedestrian on a sidewalk, causing serious injuries.

On January 15, 2012, Mr. Zhu drove an unregistered electric tricycle and turned left onto a sidewalk, colliding with Ms. He, a pedestrian. Traffic police found Mr. Zhu fully at fault. Ms. He was hospitalized with injuries requiring ongoing treatment.

By the time of litigation, Ms. He had incurred 109,401.48 yuan in medical expenses. Mr. Zhu had already paid 62,500 yuan toward her care plus 1,001.78 yuan for examination fees. The outstanding balance was 46,901.48 yuan.

Ms. He sought immediate payment of all accrued medical expenses, with the understanding that amounts Mr. Zhu had already paid would be reconciled later.

The court held that Mr. Zhu’s violation of traffic laws caused Ms. He’s injuries. As the fully at-fault party, he was liable for her medical costs. The court ordered him to pay the outstanding 46,901.48 yuan within ten days.

The court did not address future medical expenses, as Ms. He remained hospitalized at the time of judgment. The case acceptance fee of 1,244 yuan was assessed against Mr. Zhu.
