An electric bicycle rider in Zhejiang Province has been awarded 5,666 yuan in compensation after being injured in a collision with a car at a hospital entrance. The court found the car driver primarily responsible for the accident.

The accident occurred on November 14, 2011, when a car driver collided with an electric bicycle at the entrance of a hospital on Center Road. Traffic police determined that the car driver bore primary responsibility while the bicycle rider bore secondary responsibility.

The bicycle rider suffered injuries requiring medical treatment and also incurred vehicle repair costs. The rider filed a lawsuit seeking compensation for medical expenses of 1,822.3 yuan, lost wages of 3,383.14 yuan, vehicle repair costs of 300 yuan, towing and parking fees of 76 yuan, and assessment fees of 100 yuan.

The car driver argued that he had not refused to compensate the rider, but rather that the compensation should be handled through his insurance company. The driver had mandatory traffic accident liability insurance on his vehicle.

The court verified the rider’s losses. Medical expenses of 1,822.3 yuan were supported by invoices and medical records. Vehicle repair costs of 300 yuan were supported by assessment reports and invoices. Towing and parking fees of 76 yuan and assessment fees of 100 yuan were also documented.

For lost wages, the rider presented wage statements showing monthly income. The court calculated the lost wages based on these documents and adjusted the claim to 3,367.7 yuan.

On March 15, 2012, the court ordered the car driver to pay 5,666 yuan in total compensation. Since the driver had insurance, the compensation would typically be paid by the insurance company within the mandatory insurance limits.

This case illustrates how courts handle relatively minor traffic accidents where injuries and property damage are modest. Even in smaller cases, courts require supporting evidence for each category of claimed losses and adjust amounts that lack adequate documentation.
