Court Awards CNY 79,865.70 in Motorcycle Accident Case
A dispute over a motorcycle accident has been resolved in an Eastern China City court, with the defendant ordered to pay nearly 80,000 CNY in damages. The plaintiff, Ms. Zhang, suffered serious leg injuries when she was struck from behind while walking along a roadside. The court found the defendant, Mr. Yang, fully liable for the collision and issued a judgment covering medical expenses, lost income, disability compensation, and other losses.
On the evening of June 21, 2010, Mr. Yang was riding a motorcycle in Eastern China County when he encountered an oncoming vehicle with bright headlights. While maneuvering, he struck Ms. Zhang, who was pushing an electric bicycle along the roadside. The impact caused her to fall and sustain fractures to her right ankle and fibula. Ms. Zhang was taken to a local hospital, where she underwent treatment and was discharged after 26 days. Police later determined that Mr. Yang was entirely at fault, while Ms. Zhang bore no responsibility. Mr. Yang’s motorcycle was not insured under the mandatory traffic accident liability insurance scheme.
During the hearing, Ms. Zhang presented medical records, a police accident report, and a forensic appraisal from an Eastern China City judicial institute. The appraisal confirmed that she suffered a 10% disability in her right leg, requiring seven months of rest, four months of nursing care, and three months of nutritional support. She also submitted employment documents showing she had worked at a manufacturing company in Eastern China City since 2008. Mr. Yang acknowledged the accident and injuries but argued that Ms. Zhang shared some fault and that her claimed damages were excessive. He had already paid part of her medical bills.
The court carefully examined the evidence and calculated the specific losses. It accepted Ms. Zhang’s medical expenses of 1,402.70 CNY after excluding post-appraisal costs, nutritional support of 900 CNY, hospital meal subsidies of 468 CNY, nursing fees of 6,000 CNY, lost income of 15,967 CNY based on the local manufacturing industry average wage, transportation costs of 600 CNY, appraisal fees of 2,640 CNY, and disability compensation of 45,888 CNY. The court also awarded 5,000 CNY for emotional distress and 1,000 CNY for property damage to the electric bicycle. Total damages amounted to 79,865.70 CNY.
Under relevant law, the court held that because Mr. Yang’s motorcycle was uninsured and he was fully at fault, he must bear all liability. Ms. Zhang’s claim that Mr. Yang caused the accident was supported by the police report, and Mr. Yang failed to provide any evidence to support his argument that she contributed to the incident. The court noted that Ms. Zhang’s regular employment in an urban area entitled her to higher disability compensation under local standards. The emotional distress award was appropriate given her permanent injury, even though some of her claimed expenses were not fully substantiated.
This case highlights the importance of maintaining compulsory traffic insurance and the legal consequences of failing to do so. The defendant’s refusal to insure his motorcycle shifted full financial responsibility onto him. The judgment also illustrates how courts assess realistic damages based on evidence, workplace records, and local economic conditions. For anyone involved in a similar accident, the decision reinforces that victims can seek comprehensive compensation, but must provide proper documentation. The defendant was ordered to pay within ten days, with additional interest for delayed payment.
