165,558 Yuan Mortgage Default: Court Accelerates Loan Maturity and Grants Foreclosure Priority
A bank won a judgment accelerating a 15-year mortgage loan after the borrower defaulted, ordering immediate repayment of 165,558 yuan in outstanding principal and interest while granting the bank priority foreclosure rights on the mortgaged property.
In November 2007, the borrower signed a personal housing loan agreement with the bank for 180,000 yuan to purchase an apartment. The 15-year loan carried an annual interest rate of 6.426 percent, with monthly repayments of principal and interest. The borrower mortgaged the purchased apartment as security, and the spouse consented to the mortgage in writing. The contract stipulated that default would permit the bank to declare the loan immediately due and payable, with overdue interest calculated at 50 percent above the contractual rate.
The bank disbursed the loan in September 2007, but the borrower quickly fell behind on payments. By April 2011, the accumulated arrears included 2,018.88 yuan in overdue principal and 2,912.69 yuan in overdue interest, with the total outstanding balance reaching 165,558.25 yuan. Despite repeated collection efforts, the borrower made no further payments.
Both the borrower and spouse were served by public notice but failed to appear in court or submit any defense. The court treated their absence as a waiver of litigation rights and confirmed the facts based on the bank’s documentary evidence, including the loan agreement, mortgage certificate, disbursement voucher, marriage certificate, and consent declaration.
The court found the loan agreement valid and enforceable. The borrower’s persistent default justified accelerating the loan maturity and demanding immediate repayment. The spouse, having consented to the mortgage and the debt occurring during marriage, bore joint liability for the full amount. The bank was also awarded 10,677 yuan in attorney fees as stipulated in the contract, and confirmed priority rights over the mortgaged property’s sale proceeds. The combined court and public notice fees of 4,425 yuan were charged to both defendants.
