58,223 Yuan Motorcycle-vs-Tricycle Crash: Uninsured Driver Must Pay Full Compensation Out of Pocket
A driver who operated an unregistered tricycle without mandatory traffic insurance was ordered to pay 58,223 yuan in full compensation after causing a collision that left a motorcyclist with a grade-ten disability, with the court applying the equivalent insurance limit since no policy existed.
In July 2011, a farmer driving an unregistered three-wheeled agricultural vehicle along a rural road collided head-on with an oncoming motorcycle. Traffic police determined the tricycle driver bore primary responsibility for driving without a license, carrying an unsecured load, and failing to keep right during passing. The motorcyclist bore secondary responsibility for riding without a license and failing to ensure safety.
The motorcyclist was hospitalized for 19 days with facial scarring exceeding 10 centimeters, constituting a grade-ten disability, and required future surgery to remove internal fixation hardware estimated at 6,000 yuan. Medical expenses totaled 43,873.78 yuan. The court assessed total economic losses at 70,410.42 yuan, including disability compensation of 13,980 yuan, lost income of 3,490.56 yuan, nursing costs of 614.08 yuan, and mental distress damages of 1,500 yuan.
Because the tricycle driver had not purchased mandatory traffic insurance, provincial regulations required him to bear the equivalent of the insurance coverage limit out of his own funds. The court applied the mandatory insurance structure: the driver was required to pay 10,000 yuan for medical-related expenses, plus 19,785 yuan for disability, lost income, and other non-medical losses within the insurance equivalent limit. For the remaining 40,626 yuan in losses beyond the insurance-equivalent threshold, the driver bore 70 percent based on his primary fault, adding 28,438 yuan.
The court rejected the driver’s attempt to challenge the traffic police accident determination, noting he provided no evidence to contradict the official finding. Claims for vehicle damage were also denied for lack of evidence. The total compensation of 58,223 yuan was ordered paid within seven days, with double interest on delayed payments. Court costs of 1,470 yuan were split with the driver paying 1,270 yuan and the motorcyclist 200 yuan.
