A shoe material supplier won a judgment for 108,330.75 yuan in unpaid goods against a footwear manufacturer whose legal representative fled after accumulating debts to multiple creditors. The court ruled in the supplier’s favor after the defendant company failed to appear in court.

The supplier, an individual engaged in the shoe material production business, had maintained a commercial relationship with the manufacturer since early 2011. The supplier delivered various shoe materials as ordered by the company, which acknowledged receipt through warehouse receipts and payment settlement statements. The manufacturer repeatedly delayed payment, citing cash flow difficulties.

The situation deteriorated dramatically in September 2011 when the company’s legal representative fled, leaving all debts unpaid. Investigation revealed that the company’s factory buildings had already been mortgaged to banks, raising serious concerns about the supplier’s ability to recover the outstanding amount.

Court records showed three confirmed settlement statements: one dated April 21, 2011 for 20,550 yuan, another dated June 23, 2011 for 34,870 yuan, and a third dated August 25, 2011 for 39,900 yuan. Additionally, between August 4 and September 16, 2011, the company received goods worth 13,010.75 yuan that were never paid for. The total outstanding balance came to 108,330.75 yuan.

The manufacturer was properly served with court notice but failed to appear or submit any defense, which the court treated as a waiver of the right to challenge the claims. The court found the supply relationship legally established and the debt clearly documented through the settlement statements and delivery records.

The court ordered the company to pay the full 108,330.75 yuan within three days of the judgment taking effect, plus delayed payment interest at double the standard rate if payment was not made on time. The 2,467 yuan court fee was also charged to the defendant company.
